Shipping & Delivery Terms

Shipping Costs

• Orders over €50 are shipped free of charge.

• For orders below €50, shipping costs will be calculated at checkout.

Dispatch & Delivery

1. Orders placed and paid on business days before 4:00 PM (CET) are dispatched the same day.

2. IronSignShop ships orders directly; in most cases, delivery takes place the next business day.

3. Delivery times may vary depending on the carrier and circumstances beyond our control.

Stock Availability

All products display current stock levels to prevent unexpected issues. If, in rare cases, actual stock differs from what is shown in the webshop, we will contact you as soon as possible and offer a suitable solution.

Definitions

• IronSignShop: IronSignShop, located in Biezenmortel, The Netherlands, registered with the Dutch Chamber of Commerce under KvK number 89731948.

• Customer: the party that enters into an agreement with IronSignShop.

• Parties: IronSignShop and the customer jointly.

• Consumer: a customer acting as a private individual and not in the course of a business or profession.

Applicability of Delivery Terms

• These delivery terms apply to all offers, orders, agreements, and deliveries of products and services by or on behalf of IronSignShop.

• Deviations from these terms are only valid if expressly agreed upon in writing.

• The applicability of additional or conflicting terms and conditions of the customer or third parties is expressly excluded.

Right of Suspension

Unless the customer is a consumer, the customer waives the right to suspend performance of any obligation arising from the agreement.

Retention of Title

1. All delivered products remain the property of IronSignShop until the customer has fulfilled all payment obligations.

2. Until ownership has transferred, IronSignShop may reclaim the delivered products at any time.

3. Before ownership has transferred, the customer may not pledge, resell, dispose of, or otherwise encumber the products.

4. If IronSignShop invokes retention of title, the agreement will be deemed dissolved and IronSignShop is entitled to claim damages, lost profits, and interest.

Delivery

• Delivery takes place while stocks last.

• Delivery takes place from IronSignShop, unless otherwise agreed.

• Online orders are delivered to the address provided by the customer.

• If payment is not made or not made on time, IronSignShop may suspend its obligations until payment has been completed. In case of late payment, the customer cannot hold IronSignShop liable for delayed delivery.

Delivery Times

• Delivery times stated by IronSignShop are indicative and do not entitle the customer to compensation or cancellation unless explicitly agreed otherwise in writing.

• The delivery period starts once the customer has completed the order process and received an order confirmation.

• Exceeding the delivery time does not entitle the customer to compensation or termination unless IronSignShop fails to deliver within 14 days after written notice.

Actual Delivery

The customer must ensure that delivery of the ordered products can take place without delay.

Transfer of Risk

The risk of loss, damage, or depreciation transfers to the customer at the moment the products are delivered to the customer or placed under the customer’s control.

Transport Costs

Transport costs are borne by the customer, unless otherwise agreed.

Packaging and Shipping Damage

1. If the packaging of a delivered product is opened or damaged, the customer must have this noted by the carrier before accepting delivery.

2. If the customer arranges transport themselves, any visible damage must be reported to IronSignShop prior to transport.

3. Failure to do so may release IronSignShop from liability for damage.

Force Majeure

• IronSignShop is not liable for failure or delay in performance due to circumstances beyond its control as defined under Article 6:75 of the Dutch Civil Code.

• Obligations are suspended for the duration of the force majeure situation. If force majeure lasts longer than 30 calendar days, either party may terminate the agreement in writing.

• IronSignShop is not liable for any damages resulting from force majeure.

Amendments to the Agreement

If changes to the agreement are necessary after conclusion, the parties will amend the agreement in mutual consultation.

Amendments to Delivery Terms

1. IronSignShop may amend these delivery terms at any time.

2. Minor changes may be implemented immediately.

3. Significant changes will be communicated in advance where reasonably possible.

Transfer of Rights

Customer rights arising from an agreement may not be transferred to third parties without prior written consent from IronSignShop. This provision has proprietary effect pursuant to Article 3:83(2) of the Dutch Civil Code.

Invalidity

If any provision of these delivery terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

Governing Law and Jurisdiction

• All agreements and delivery terms are governed exclusively by Dutch law.

• Disputes shall be submitted exclusively to the competent court in the district where IronSignShop is established.

Right of Withdrawal (Returns)

• You have the right to cancel your order within 30 days of receipt without giving any reason. After cancellation, you have an additional 30 days to return the product.

• You will receive a full refund of the order amount including original shipping costs. Return shipping costs are at your own expense.

• Returned products must be complete, unused where reasonably possible, and in their original condition and packaging.

• Refunds will be processed within 30 days after the return has been registered, provided the product has been received in good condition.
